These Terms & Conditions (“Terms”) govern your access to and use of the services provided by PSM Video Productions, including but not limited to videography, video editing, and video distribution services. By accessing our website or hiring us for services, you agree to comply with and be bound by the following terms.

1. Definitions

1.1 “Company,” “We,” “Our,” and “Us” refer to PSM Video Productions, LLC.

1.2 “Client,” “You,” “Your” refers to any individual or entity that engages with PSM Video Productions for services.

1.3 “Services” includes all videography, video editing, video production, and video distribution services provided by PSM Video Productions.

1.4 “Content” refers to any video, audio, scripts, graphics, or materials created or delivered as part of our services.

2. Scope of Services

2.1 We provide full-service video production, including pre-production, filming, editing, and final delivery.

2.2 Specific service categories include:

• Personal Videography (weddings, events, memorials)
• Corporate Videography (commercials, training, product demos)
• Organizational Videography (nonprofits, community outreach)
• Music Video Production
• Video Editing Services
• Video Distribution Services

2.3 A detailed scope of work will be defined in each project proposal or contract.

2.4 Subcontractors
We may engage trusted subcontractors to assist in providing certain aspects of services. All subcontractors are bound by the same confidentiality and quality standards outlined in these Terms.

3. Booking & Payment Terms

3.1 A signed agreement and deposit are required to confirm a booking.

3.2 Payment terms are as follows unless otherwise stated:

• 50% deposit upfront
• 25% mid-project milestone
• 25% upon final delivery

3.3 Payment is accepted via bank transfer, credit card, or other methods specified in the invoice.

3.4 Late payments may incur a fee of 2% per month or the maximum allowed by law.

3.5 If an account remains unpaid for more than XX days after final delivery, PSM Video Productions reserves the right to take legal action or engage a collections agency. Any additional fees or legal costs incurred will be the responsibility of the client.

4. Client Responsibilities

4.1 Clients must provide accurate project details, expectations, and relevant materials before production begins.

4.2 Clients must secure all necessary permissions for filming at specific locations or involving third-party participants.

4.3 Clients must attend scheduled review sessions and provide timely feedback to avoid project delays.

4.4 Clients are responsible for ensuring all content they supply (e.g., music, logos, scripts) is properly licensed. PSM Video Productions is not liable for copyright infringement related to client-supplied materials.

5. Revisions & Delivery

5.1 The standard service includes two round of revisions unless otherwise agreed.

5.2 Additional revisions requested after final approval may incur extra charges.

5.3 Final content is delivered digitally in formats agreed upon in the project scope.

5.4 Delivery timelines are estimated and subject to change based on feedback, external factors, or unforeseen events.

6. Intellectual Property Rights

6.1 All original content produced by PSM Video Productions remains the intellectual property of the company until full payment is received.

6.2 Upon full payment, the client receives a non-exclusive, royalty-free license to use the final video for its intended purpose.

6.3 We reserve the right to use completed projects for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.

6.4 Raw footage remains the property of PSM Video Productions unless separately purchased or licensed.

5.5 We will retain a backup of your final files for 90 days post-delivery. Long-term file storage or retrieval beyond that period may incur additional fees.

7. Cancellation & Refund Policy

7.1 Cancellations made more than 30 days before the scheduled shoot may be eligible for a partial refund.

7.2 Cancellations within 30 days of the scheduled production date are non-refundable.

7.3 In the event of a cancellation by PSM Video Productions due to illness, emergency, or force majeure, all deposits will be refunded or rescheduled as agreed with the client.

7.4 Clients may request to reschedule up to one time without penalty, provided the request is made at least 30 days before the scheduled shoot.

8. Liability & Disclaimers

8.1 PSM Video Productions is not liable for delays caused by weather, technical failures, acts of God, or failure of the client to fulfill obligations.

8.2 We are not responsible for third-party licensing issues unless such services are explicitly included in the contract.

8.3 While we take all reasonable steps to protect data, we are not liable for data loss due to client negligence or third-party hosting issues.

8.4 Our services are subject to limitations based on local regulations, location access, and technical feasibility. We will inform clients promptly if any limitation impacts the project.

9. Confidentiality

9.1 We agree to keep all client information confidential and will not disclose project details to third parties without written consent.

9.2 Clients agree not to disclose PSM Video Productions’ pricing structures, proposals, or internal communications.

10. Use of Website

10.1 All content on our website, including text, graphics, logos, and videos, is the property of PSM Video Productions and may not be reproduced without permission.

10.2 Unauthorized use of our website or content may result in legal action.

11. Governing Law

11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions.

11.2 Any disputes arising from these Terms shall be resolved in the state or federal courts located in the United States.

12. Amendments

12.1 We reserve the right to update or modify these Terms at any time.

12.2 Continued use of our services or website constitutes acceptance of the revised Terms.
